Please read these Terms of Service ("Terms") carefully. They govern your access to and use of the websites, applications, and services offered by Jubilant Careers ("Jubilant Careers," "we," "us," or "our"), including jubilantcareers.com and any related services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Who We Are and What We Do

Jubilant Careers operates a hiring and career-development platform that connects job candidates ("Candidates") with employers ("Employers") based on skills, personality, values, and goals, and that offers learning and professional-development tools, an AI teammate suite, and related services. Instructors ("Instructors") may offer educational content through the Service. Candidates, Employers, and Instructors are collectively "Users."

Jubilant Careers is a technology platform. We are not an employer, employment agency, or staffing agency with respect to the relationships formed between Candidates and Employers, and we are not a party to any employment agreement, engagement, or arrangement between Users. We do not guarantee that any Candidate will be hired, that any Employer will find a suitable Candidate, or the conduct, qualifications, or suitability of any User.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements and that all information you provide is accurate and complete.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

4. Candidate Services

Candidates may create a profile, complete assessments, receive fit-based matches, message Employers, use learning tools, and upload video introductions. Assessments, matches, and fit scores are informational tools to assist decision-making; they are not guarantees of employment, performance, or suitability. You are responsible for the accuracy of the information in your profile.

5. Employer Services; Fees

Employers may post roles, review fit-scored Candidate shortlists, message Candidates, and subscribe to paid plans. Employers agree to use Candidate information only for legitimate hiring purposes and in compliance with all applicable employment, anti-discrimination, and privacy laws. Employers are solely responsible for their hiring decisions and for compliance with all laws governing their employment practices.

Subscriptions are billed in advance on a recurring basis (monthly or annually) through our payment processor. Placement fees and other one-time charges are billed when the applicable event occurs (for example, a successful hire or a priority service). Fees are described at the point of purchase and are subject to change on notice. Except where required by law or expressly stated, fees are non-refundable. You authorize us and our payment processor to charge your payment method for all fees you incur.

6. Instructor Services

Instructors may publish educational content and earn a revenue share on sales as described at signup (currently, Instructors retain 80% of applicable course sales, with Jubilant Careers retaining 20%). Instructors are responsible for the accuracy, legality, and quality of their content and represent that they have all rights necessary to offer it.

7. Continuing Education Marketplace

The Service may include a directory of third-party continuing education ("CE") providers and courses. Jubilant Careers is a directory and referral service only. We do not accredit, provide, or guarantee CE credit. All CE courses listed are created, delivered, and accredited (where applicable) by the third-party provider, not by Jubilant Careers. We may earn a referral commission when you enroll through our links, at no additional cost to you. You are responsible for verifying that any course satisfies your professional licensing requirements with your applicable licensing board before enrolling. Professional-development content offered directly by Jubilant Careers is for skill-building only and does not confer continuing education credit toward professional licensure unless expressly stated and accredited.

8. Payments

Payments are processed by Stripe, Inc. We do not store full payment card numbers. Your use of payment features is subject to Stripe's terms and privacy policy. You are responsible for providing accurate billing information.

9. User Content

You may submit content to the Service, including profile information, messages, videos, and other materials ("User Content"). You retain ownership of your User Content. You grant Jubilant Careers a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your User Content solely as needed to operate and provide the Service (for example, sharing a Candidate's video introduction with an Employer you choose).

You are solely responsible for your User Content and represent that you have all rights necessary to submit it and that it does not violate any law or third-party right. You agree not to submit content that is unlawful, defamatory, harassing, discriminatory, obscene, fraudulent, or infringing.

Video Content

Candidate video introductions are shared only with Employers you choose or through features you activate. We may use automated and human review to enforce these Terms. We may remove, disable, or refuse any video that violates these Terms or that is reported, and we may suspend accounts that misuse video features. Do not include in any video content that is unlawful, harassing, sexually explicit, discriminatory, or that reveals sensitive personal information you do not wish to share with Employers.

10. AI-Assisted Features

The Service uses artificial intelligence to generate matches, fit scores, learning plans, and other outputs. AI outputs may be inaccurate or incomplete and are provided as decision-support tools, not as professional, legal, financial, or employment advice. You are responsible for independently evaluating any AI-assisted output before relying on it.

11. Acceptable Use

You agree not to: (a) use the Service for any unlawful or discriminatory purpose; (b) misrepresent your identity or qualifications; (c) scrape, harvest, or misuse other Users' data; (d) interfere with or disrupt the Service or attempt to gain unauthorized access; (e) use the Service to send spam or unsolicited communications; (f) reverse engineer or copy the Service; or (g) use another User's information for any purpose other than the legitimate purpose for which it was shared.

12. Intellectual Property

The Service, including its software, design, branding, and content (excluding User Content), is owned by Jubilant Careers and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service in accordance with these Terms. All rights not expressly granted are reserved.

13. Third-Party Services and Links

The Service integrates or links to third-party services (including Stripe, Google, and third-party CE providers). We are not responsible for the content, policies, or practices of third parties. Your use of third-party services is governed by their terms.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT MATCHES OR ASSESSMENTS WILL BE ACCURATE, OR THAT ANY HIRE OR ENGAGEMENT WILL RESULT FROM YOUR USE OF THE SERVICE.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUBILANT CAREERS AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

16. Indemnification

You agree to indemnify and hold harmless Jubilant Careers from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your User Content, your violation of these Terms, or your violation of any law or third-party right.

17. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access at any time for any violation of these Terms or to protect the Service or other Users. Provisions that by their nature should survive termination will survive.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms with a new "Last updated" date or by other reasonable means. Your continued use of the Service after changes take effect constitutes acceptance.

19. Governing Law and Disputes

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Ohio, and you consent to personal jurisdiction there.
